“Online” purchase and sale contract means the distance contract, that is, the legal transaction having as its object moveable property and/or services stipulated between a supplier (Lucidivia S.r.l.s. with registered office in Rome, Via Antonino Saetta 23 00173 CF/P.IVA 15938351002) and a consumer customer within a distance selling system organised by the supplier which, for this contract, uses exclusively the distance communication technology called “internet”. All contracts, therefore, will be concluded directly through access by the customer consumer to the website corresponding to the address Lucidivia.com, where, following the indicated procedures, the contract for the purchase of the good will be concluded. Below are the conditions of sale that will remain effective until they are changed by the supplier. Any changes to the conditions of sale will be effective from the moment they are published on the Lucidivia.com website or communicated by email and will refer to sales made from that moment on. The Customer, with the electronic confirmation of the order, declares to have read and to accept in full the conditions of sale and payment indicated in the purchase process and in this contract; he also undertakes to read, print and store the conditions of sale below as provided for in articles 3 and 4 of Legislative Decree no. 185/1999. It is expressly forbidden to enter false and/or invented personal data within the data collection forms necessary for the completion of the order; it is also expressly forbidden to enter data of third parties or make multiple registrations for a single Consumer. The Supplier reserves the right to pursue such actions and any other fraudulent action against it and/or to the detriment of other Consumers. Credit card orders issued only by the cardholder will be accepted. Payment security is guaranteed by Paypal and the transaction takes place directly on a protected area with encryption. For greater guarantee and security of the Customer, at no time during the purchase procedure is Lucidivia.com able to know the information relating to the buyer’s credit card, transmitted via a secure connection directly to the website of the banking institution that manages the transaction. No Lucidivia.com computerised archive will retain this data. Under no circumstances can Lucidivia.com therefore be held responsible for any fraudulent and improper use of credit cards by third parties, at the time of payment of purchased products. SHIPPING

Lucidivia.com makes use of the close collaboration of several national couriers that it chooses to use from time to time depending on the type of product. All shipments are trackable. To immediately simplify the evaluation of the final costs for the customer, Lucidivia.com applies a tariff policy calculated on the basis of the weight and size of the goods purchased. The “Order Received” confirmation email indicates that the procedure has been correctly received, while the “In Process” email message informs the buyer that the order is being prepared which will be followed by a further “Order Completed” email at the successful outcome of the payment. In case of payment by “Bank Transfer” the completed order status will take place at the time of crediting at the reference banking institution. The last email sent concerns the status of “Shipped”. From that moment on, an average of 2 to 7 working days may pass for the actual delivery, depending on the distance, the carrier, the type of product and the destination area (Sicily, Calabria, Sardinia and all the “Peripheral” and “Uncomfortable” locations available on the website of www.poste.it may be subject to additional rates and/or have delays in deliveries) and based on the availability of the product. For “Urgent” orders it is advisable to ask for availability in advance of purchase. No courier transports to the floor, so the customer is asked to organise in case of bulky and/or heavy packages. The single rate also does not include purchases of large quantities of products that should require the rental of one or more platforms by Lucidivia.com In these circumstances the price will be communicated by email or telephone to the customer who will have full right to accept or cancel the order. WARRANTY

Except for specific extensions indicated in the product sheet, all purchased products enjoy the warranty provided by the manufacturer of 2 years (1 year if the purchase was with VAT or EXTRA UE TAXID) provided that the product itself has been used correctly, in compliance with its intended use and the provisions of the attached technical documentation, provided by the manufacturer. Return and exchange shipments under warranty are at the expense of Lucidivia.com while shipments to Lucidivia.com by the customer requesting warranty intervention, are always at the expense of the same. In order to take advantage of the guarantee it is essential to provide references to be able to go back to the date of purchase, or more simply communicate the invoice number.

RIGHT OF WITHDRAWAL

The Customer, pursuant to art. 64 of Legislative Decree no. 206/05, has the right to withdraw from the purchase contract for any reason, without any penalty and subject to what is indicated in point 3 below. The right of withdrawal can only be used by natural persons (final consumer of the good, that is, by a Customer who buys the goods for purposes not related to his professional activity). The right of withdrawal may be exercised by the Customer within 14 (fourteen) working days from the receipt of the product by the Customer, by sending a registered letter with acknowledgement of receipt, anticipated by e-mail to the address info@lucidivia.com in which it will also be necessary to indicate the bank details necessary to return the sums paid. The right of withdrawal is subject to the following mandatory conditions: the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (e.g.: accessories, attached software, etc..); the purchased good must be intact and returned in the original packaging, complete in all its parts including packaging and any documentation and accessory equipment (manuals, cables, etc…); to limit damage to the original packaging, we recommend, when possible, to insert it in a second box; the good subject to exercise of the right of withdrawal must be returned in a normal state of conservation, as it has been Kept and possibly used with the use of normal diligence: therefore, used products that show signs of damage or dirt and that consequently can no longer be considered intact will not be accepted; The return must be carried out by the Customer, through the shipment of the products subject to the withdrawal, by courier of his choice. In the latter case, it will be the customer’s responsibility to promptly provide the bank details on which to obtain the refund (Cod. IBAN of the invoice holder). The right of withdrawal completely lapses, due to the lack of the essential condition of integrity of the good (packaging and/or its contents), in cases where Lucidivia.com ascertains: the lack of the outer packaging, broken blister and/or the original internal packaging; the absence of integral elements of the product (accessories, cables, manuals, parts, etc…) or anomalies to the product itself the damage to the product; a state of dirt of the product due to its use, which has compromised its integrity. The costs and risks of transport for the return are fully borne by the Customer. The return of products that are not intact, deteriorated or without original accessories and equipment will not be accepted by Lucidivia.com and will be returned to the sender with increased transportation costs.
